Patent applications: the three criteria
- Novelty. This means that your invention must not have been made public – not even by yourself – before the date of the application.
- Inventive step. This means that your product or process must be an inventive solution.
- Industrial applicability.
The most common type of patent, which lasts 20 years from the filing date. If the application was filed before June 8, 1995, the patent lasts 17 years from the grant date or 20 years from the filing date, whichever is longer.
